A PROPOSAL TO REFORM U.S. LAW AND POLICY RELATING TO THE INTERNATIONAL EXCHANGE OF CULTURAL PROPERTY

Sometime in 2011, one of my London-based antiquities dealer clients told me that the “United States is a mess. It’s a terrible place to do business. Collectors are worried, curators are frightened, and your government seems to have gone mad in pursuit of a vendetta against the antiquities trade.” I agreed. He asked me why. I said that the answer was long and complicated but that basically, U.S. law had evolved to a point 180 degrees from where it was supposed to be back in the 1980s, which was the first (and last) time Congress focused on cultural property issues. He asked me what to do about it.
